ORDER approving technical norms for the purpose of customs registration of economic operators and other persons

 

Regulation (EC). 312/2009 of the European Commission of 16.04.2009, amending Regulation (EEC) no. 2.454/93 laying down provisions for implementing Regulation (EEC) no. 2.913/92 of the Council establishing the Community Customs Code, establishes a requirement that each economic operator, and, if appropriate, other people have assigned after 1 July 2009, a registration and identification, called EORI. Number EORI will be a common reference in their relations with customs authorities, on the whole territory of the European Union and for the exchange of information between authorities and between customs authorities and customs authorities.

For the application of Community regulations, the National Agency for Tax Administration has drafted new rules on technical registration for customs purposes of economic operators and other persons who have been approved by this Order.
Who needs to obtain:

  • operators (those who in their professional activities covered by the exercise customs law, operations such as import, export, transit, storage, representation and operations prior to arrival / departure of goods that inserted / removed from the territory of the Community)
  • individuals who introduce / remove goods from the European Union.

 

Application for award number EORI completed by the persons mentioned above, using "EORI-EN, by accessing the link on the website of the National Customs: www.customs.ro, the" e-Customs ", subsection EORI, informatic system.

The application is registered in the application "EORI-RO" is printed and filed, signed and stamped by the applicant, the regional direction for excise and customs operations in a range whose territorial jurisdiction is established that the residence in case of established romania, or at the direction of regional excise and customs operations in which the territorial reach of the applicant are to work, if economic operators and other persons not established in the Union.

In the case of operators who are holders of TIR carnets, the application is submitted to the office of the border that are introduced or removed goods to / from the Community customs territory.
The application is submitted to the competent customs authority together with documents to support information curpinsul them.
For example, in case of operators settled in Romania, the application for a number EORI is accompanied by the following documents in photocopy:

a) certificate of registration issued by the National Trade Register,
b) the certificate of registration for VAT purposes by the Ministry of Finance, as appropriate
c) documents that result from the registered office or domicile of the current fiscal, as appropriate, in situation does not correspond to that registered in the certificate (s) presented

In case the application "EORI-RO" does not work, the applicant completes an application and submit to the direction of regional operations for excise and customs / border customs office, together with related documents.

On coming into force of this Order shall repeal Order Vice-Chairman of the National Agency for Fiscal Administration no. 691/2009 for the approval of Technical Norms on registration and identification economci established operators in Romania, published in the Official Gazette no. 106/20.02.2009.
